Terms of Sales

1 - PRICE

The prices of our products are indicated in euros all taxes included, and excluding the cost of processing and shipping (see § AVAILABILITY / DELIVERY). 
All orders are payable in euros. 
Sweet'Art reserves the right to change prices at any time but the products will be billed based on the rates in effect at the time of registration of orders, subject to availability on that date. In case of delivery to a country other than metropolitan France the recipient of the order will be considered the importer of the product or products concerned. 
All prices of the site are inclusive of VAT (all taxes included). 

Retention of title clause: the products remain the property of Sweet'Art until full payment of the price by Sweet'Art.

2 - PAYMENT METHOD / ORDER TAKING

By credit card : 
Sweet'Art uses PAYPAL as a secure payment system on the Internet. 
The data relating to your credit card number is encrypted from your computer and transmitted and encrypted directly to the bank operator, which decrypts and manages the authorization of withdrawal. 
- Any attempt at fraud, for any amount whatsoever and whatever its origin, will be subject to criminal prosecution. All the data collected about you will then be sent to the prosecution for investigation. 
Reminder of the terms of Article 313-1 of the Penal Code: 
"The fraud is the fact, either by the use of a false name or a false quality, or by the abuse of a true quality, or by the use of fraudulent maneuvers, to deceive a natural person or moral and so determine, to its prejudice or the prejudice of a third party, to remit funds, securities or any property, to provide a service or to perform an act operating obligation or discharge. 
The scam is punishable by five years of imprisonment and a fine of € 375,000. "

3 - AVAILABILITY / DELIVERY

Orders are sent by courier within approximately three business days. 
For shipments outside the European Union, any taxes (local, customs or import VAT) may be invoiced upon arrival of the package to destination and will remain the responsibility of the recipient. 

Shipping: 
Packages are delivered in France and Europe with the Colissimo carrier. 

Shipping cost: 
The shipping costs are calculated automatically and appear on the order form according to the total weight of your order and the country of dispatch. 

Availability: 
In case of unavailability of product after placing the order, the Purchaser will be informed by email or telephone of the items in disruption. The buyer can then request the exchange or refund of his order by completing our contact form. It will be refunded within 15 days at the latest according to art L. 121-20-3 of the Consumer Code. 

Delivery time : 
The times indicated are average times and correspond to processing times and delivery. Deadlines vary by destination and do not include holidays and weekends. The delivery deadline is 10 days from the date of the order. 
In case of non-compliance with this deadline, the consumer can obtain the resolution of the sale under the conditions set out in the second and third paragraphs of Article L. 114-1 of the Consumer Code. It is then reimbursed under the conditions of Article L. 121-20-1.

4 - CUSTOMER SERVICE

5 - SATISFIED OR REFUNDED

According to article L121-20 of the Consumer Code, you have a withdrawal period of 15 days (from the date of delivery) to request the exchange or refund of your order to our customer service by filling out our contact form.If this right is exercised, the seller will be required to refund the purchase within 15 days maximum. 

The buyer can either exchange the product or get a refund while the recipient can either exchange the product or ask for the buyer's refund.This point applies to defective products, whose size is not good or not in accordance with his order. 
On the other hand, we will not be able to resume: 
- items returned incomplete, damaged, damaged or soiled by the customer,
- undelivered items with their labels in their original packaging (if present), 
- parcels for which there is no attached element to identify the sender (order number, surname, first name, address). 

To return products the sender will have to send the products to the following address:

The return of the products will result in an exchange or a refund equal to the purchase price of the product (s) purchased. 

If you wish to be reimbursed, we advise you to contact us by email by completing our contact form. We will refund you in Euros by the payment method identical to your order, whatever the country, to the address which you will leave us, in the days which follow and after reception of the articles to be exchanged, within a deadline not exceeding 15 days. 

No return shipment in cash on delivery will be accepted, whatever the reason.

6 - RESPONSIBILITY

The products offered comply with the French legislation in force and the standards applicable in France. The photographs, texts, graphics information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, the responsibility of Sweet'Art can not be engaged in case of error or omission in one of these photographs, texts or graphics informations or characteristics of the products. Of course for any questions about the products you can contact our customer service. Sweet'Art can not be held responsible for non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike including postal services and means of transport and / or communications , flood, fire. In any case, any delay in delivery can not give rise to damages, withholding or cancellation of orders in progress.

7 - NOMINATIVE INFORMATION

Sweet'Art undertakes not to disclose to third parties the information you provide us. These are confidential. They will be used by its internal services for the processing of your order and only to strengthen and personalize the communication and the product offer reserved for Sweet'Art customers. 
Accordingly, in accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify and oppose personal data about you. 
For this it is enough to us to make the request on line by indicating us your name, first name, address and if possible your customer reference:

8 - INTELLECTUAL PROPERTY

All the texts, comments, works, illustrations and images reproduced on the sites published by Sweet'Art are reserved under copyright as well as intellectual property rights and for the whole world. As such and in accordance with the provisions of the Code of Intellectual Property, only the use is authorized for private use subject to different or even more restrictive provisions of the Code of Intellectual Property. Any other use is constitutive of counterfeit and sanctioned under the Intellectual Property except prior authorization of Sweet'Art. Any total or partial reproduction of the sites published by Sweet'Art is strictly prohibited.

9 - LITIGATION

Any dispute settlement can be made with our customer service and, failing a friendly settlement, it will be under the jurisdiction of a French commercial court according to the rules of Article 46 of the Code of Civil Procedure. 

10 - CUSTOMER COMMITMENT

During the validation of his order, the buyer declares to accept fully and without reserve this order as well as the entirety of the present General Conditions of Sale. 
The data recorded by Sweet'Art is proof of all transactions between Sweet'Art and its customers. 
These general conditions of sale are governed by French law and may be modified at any time without notice.
